NOTICE
This meeting will be held virtually and in-person at the Council Chambers located on 2415 University Ave, First Floor East Palo Alto, CA 94303. The virtual portion of this City Council meeting will be conducted in accordance with City of East Palo Alto Resolution adopted pursuant to Assembly Bill 361.

The public may participate in the City Council Meeting via Zoom Meeting or by attending in-person in the Council Chambers at 2415 University Ave, First Floor East Palo Alto, CA 94303. Community members may provide comments by emailing cityclerk@cityofepa.org, submitting a speaker card at the meeting, or using the RAISE HAND feature when the Mayor or City Clerk call for public comment. Emailed comments should include the specific agenda item on which you are commenting.
 
Pursuant to Government Code §54953(b), this meeting will include a teleconference location at the Marriott Marquis San Diego Marina, 333 W Harbor Dr, San Diego CA 92101, US. Councilmember Webster Lincoln will be attending the Meeting via teleconference. The public shall have the opportunity to address the City Council at this teleconference location pursuant to Government Code Section §54954.3. All votes during the teleconferencing session will be conducted by roll call vote.

3.1

Personnel Staffing Change, POA Side Letter Agreement, and Classification Specification Updates

 

Recommendation:

Adopt a resolution:

  1. Approving an amendment to the City’s Classification Plan adding 1.0 FTE Housing Specialist I/II (1 year LTD);
  2. Approving classification updates to the following:
    1. Community Services Officer
  3. Approving and establishing the related compensation schedules;
  4. Approving Police Officers’ Association (POA) side letter agreement; and
  5. Finding that the proposed actions do not constitute “projects” within the meaning of the California Environmental Quality Act (“CEQA”) pursuant to CEQA Guidelines sections 15378(b)(4) and (5) in that they are governmental fiscal, organizational or administrative activities that will not result in direct or indirect changes in the environment.

3.2

Ecumenical Hunger Program (EHP) Proclamation

 

Recommendation:

Present the proclamation for the Ecumenical Hunger Program (EHP). 

3.3

Grant Application for the 2025 Cycle 3 Transportation Demand Management (TDM) Program 

 

Recommendation:

Adopt a resolution:

 

  1. Supporting the Transportation Demand Management (TDM) Program Refinement and Implementation Project by authorizing the City Manager to submit an application to the San Mateo County Transportation Authority for the 2025 Cycle 3 TDM Program Funding program for a $150,000 grant for the TDM Program Refinement and Implementation Project and take all actions necessary to give effect to the resolution, including appropriating $7,895 in matching funding and execute legal documents to secure the grant funding; and

 

  1. Finding that the proposed action does not constitute a “project” with the meaning of the California Environmental Quality Act (“CEQA”) pursuant to CEQA Guidelines sections 15378(b)(4) and (5) in that it is a governmental fiscal, organizational or administrative activity that will not result in direct or indirect changes in the environment.

3.4

Approval of Settlement Agreement

 

Recommendation:

By motion, approve and authorize the City Attorney to sign a settlement agreement in the matter of Sandra Floyd v. City of East Palo Alto (24-CIV-00140).

3.5

City Council Meeting Minutes

 

Recommendation:

Adopt the minutes of the July 15, 2025, Meeting.

3.6

Purchase of Two Police Patrol Vehicles

 

Recommendation:

Adopt a resolution:

 

  1. Authorizing the City Manager to purchase two 2025 Dodge Durango Police Vehicles from Elk Grove Auto Group for the Police Department in an amount not to exceed $116,954.26; and

 

  1. Approve the purchase under an exception to formal bidding procedures pursuant to East Palo Alto Municipal Code Section 2.84.0740(DL); and

 

    1. Find that the proposed action does not constitute a “project” with the meaning of the California Environmental Quality Act (“CEQA”) pursuant to CEQA Guidelines sections 15378(b)(4) and (5) in that it is a governmental fiscal, organizational or administrative activity that will not result in direct or indirect changes in the environment.

10.1

2025 Sanitary Sewer Management Plan Update

 

Recommendation:

1. Adopting the 2025 Sanitary Sewer System Management Plan; and 

2. Finding that the proposed action is exempt from the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines section 15308. 

10.2

2025 Sewer System Master Plan

 

Recommendation:

Adopt a resolution:

 

  1. Approving the 2025 Sanitary Sewer System Master Plan; and
  2. Finds that the proposed action being considered by the City Council is exempt from the California Environmental Quality Act (CEQA) because it requires the implementation of management operations programs and plans to enhance and protect the environment by limiting the occurrence of SSOs in the City. (CEQA Guideline section 15308). Further, implementation of the proposed action may require the installation of minor sewer system facilities which will involve either minor alterations to existing facilities, or repair or replacement of existing facilities involving negligible or no expansion of sewer capacity, and as such, are exempt from review under CEQA Guidelines sections 15301 and 15302.

EPASD BOARD MEETING PUBLIC HEARING

 

11.1

Public Hearing and Approval of Sewer Service Charges to be Collected on the San Mateo County Tax Roll for FY 2025–26

 

Recommendation:
  1. Hold a public hearing to consider any objections or protests to the placement of EPASD’s FY 2025–26 sewer service charges on the San Mateo County secured property tax roll pursuant to Health and Safety Code §5473–5473.4; and
  2. Adopt a resolution:
    1. Confirming the written report of charges and authorizing the charges to be submitted to the County Tax Collector for collection; and
    2. Finding the proposed action does not constitute a “project” with the meaning of the California Environmental Quality Act (“CEQA”) pursuant to CEQA Guidelines sections 15378(b)(4) and (5) in that it is a governmental fiscal, organizational or administrative activity that will not result in direct or indirect changes in the environment.

14.1

Cost Allocation Plan and User Fee reports and amendment to City’s Master Fee Schedule – Continued from June 17 and July 15, 2025

 

Recommendation:

 

  1. Approving the Cost Allocation Plan and User and Regulatory Fee Study as the basis for amending the Master Fee Schedule;
  2. Amending the City’s Master Fee Schedule, based on Cost Allocation Plan and User and Regulatory Fee Study; and
  3. Finding the proposed action does not constitute a “project” with the meaning of the California Environmental Quality Act (“CEQA”) pursuant to CEQA Guidelines sections 15378(b)(4) and (5) in that it is a governmental fiscal, organizational or administrative activity that will not result in direct or indirect changes in the environment.
15.

POLICY AND ACTION

 

15.1

The New Civic Commons

 

Recommendation:

By motion:

  1. Delegate to the City Manager the authority to grant a design review permit, any other required permits for up to an approximately 102,614 square foot, four-story Civic Center on a four-acre property (separate 20,000 square foot, single-story police station on the same property will return to Council in the future and will be permitted at that time), and authority to act on all subsequent environmental clearance documents/findings, as required by applicable law (CEQA);
  2. Authorize the City Manager to negotiate and execute a memorandum of understanding (MOU), in a form approved by the City Attorney, which commits the City to use restrictions on a proposed track and field facility at the proposed Civic Commons as a condition of receiving initial grant funding;
  3. Adopt California Environmental Quality Act (CEQA) findings, based upon the analysis in this staff report, and documents in the administrative record, find that the Civic Commons is within the scope of the prior Jobtrain Office Mitigated Negative Declaration (MND) and does not trigger subsequent or supplemental environmental review under CEQA Guidelines Section 15162. Further find that that the proposed Civic Commons (including the track and field) are within the scope of the Ravenswood Business District (RBD) Final Environmental Impact Report (EIR) and incorporate the mitigation measures from that Mitigation Monitoring and Reporting Programs (MMRPs) from the RBD Specific Plan FEIR and Subsequent FEIR, and the Jobtrain MND.

15.2

EPACENTER 2025 Grant Agreement for Community Events

 

Recommendation:
  1. Adopt a resolution authorizing the City Manager to award to and negotiate and execute an agreement with EPACENTER for providing monthly Community Events at their location for no cost to the community during FY25-26 until June 30, 2026, in a form approved by the City Attorney, for $100,000, in an amount not-to-exceed $100,000 
  2. The action being considered by the City Council is exempt from the California Environmental Quality Act (CEQA) because it is not a “project” pursuant to 15378(b)(4) because it is a fiscal activity which does not involve any commitment to any specific project which may result in a potentially significant impact on the environment.
